These Terms and Conditions ("Terms") govern your access to and use of the Poach Recipes mobile application (the "App") and poachapp.com (the "Website"), together the "Services". By using the Services, you agree to these Terms. If you do not agree, you must stop using the Services.

These Terms are issued by Poach Apps Ltd, a company registered in England and Wales.

1. About Poach

Poach allows users to save and organize recipes from across the web for personal use. The App is intended for lawful and personal purposes only.

2. Your Agreement

By using Poach, you confirm that:

You have the legal capacity to enter into this agreement, meaning you are at least 18 years old or, if under 18, you have obtained the consent of a parent or legal guardian.
You will use Poach in compliance with these Terms, all applicable laws, and regulations, including those relating to copyright and intellectual property.

3. Prohibited Uses

You agree not to use Poach for the following:

Copyright Infringement: Using Poach to save, store, or share copyrighted content without the necessary permissions or in violation of applicable copyright laws. Users must ensure they have the right to save and use any content added to the App.
Commercial Use: Using Poach for commercial purposes, such as redistributing recipes or other content for profit.
Harmful Activities: Engaging in unlawful, fraudulent, or abusive activities, including attempting to hack, disable, or interfere with the App or Website.
Violation of Rights: Uploading or saving content that violates the intellectual property, privacy, or other rights of third parties.

Poach Apps Ltd may take reasonable action to prevent or address prohibited activities.

4. User Content

You retain any rights you have in content you add to Poach. You give Poach permission to host, copy, process, transform, and display that content only as reasonably necessary to provide, maintain, and improve the Services. You confirm that you have any permissions required for your use of that content.

Poach does not claim ownership of saved recipes or third-party content.

5. Copyright and Intellectual Property

Respect for Copyright: Recipes, text, images, or any other materials sourced from third-party websites remain the intellectual property of their respective owners. Poach does not claim ownership of content saved by users.
Poach as a Tool: Poach Apps Ltd provides tools for organizing user-sourced content and does not facilitate or encourage copyright infringement. Users must ensure they have the right to save and use third-party content through the App. See also Section 3 on prohibited uses and Section 11 regarding third-party websites.
Your Responsibility: Poach Apps Ltd does not monitor the legality of content saved by users. You are solely responsible for ensuring compliance with copyright laws and obtaining any necessary permissions for saved content.
Ownership of the App: The Poach mobile application, website (poachapp.com), and all associated trademarks, logos, software, and designs are the exclusive property of Poach Apps Ltd or its licensors. You may not copy, modify, or distribute these elements without express written permission from Poach Apps Ltd. This excludes any third-party content that you save using the App, which remains the property of its original owners.

6. AI-Enabled Features and Recipe Accuracy

Poach uses automated systems, including artificial intelligence, to extract, parse, structure, and classify recipe content. Results may contain errors, omissions, or changes. You should verify recipes against their original source, particularly ingredients, quantities, allergens, cooking times, and temperatures. Poach does not provide medical, nutritional, or food-safety advice.

7. Subscriptions and In-App Purchases

Prices, billing periods, and any trial terms are displayed before you make a purchase.
Payment is processed by the Apple App Store or Google Play, as applicable.
Subscriptions automatically renew unless you cancel through the relevant app store before renewal.
Deleting Poach does not cancel a subscription. You can manage or cancel a subscription through your Apple ID or Google Play account.
Refunds are handled under the relevant app store's policies. This does not affect any mandatory consumer rights you may have.
These Terms supplement the applicable Apple App Store or Google Play terms.

8. Privacy

We process personal information as described in our Privacy Policy. The Privacy Policy also explains your rights and how to contact us about personal information.

9. Local Storage and Backups

Unless a feature expressly states otherwise, your recipe library is stored primarily on your device. Poach is not a backup service. Deleting the App, clearing its data, or losing, resetting, or replacing your device may result in the loss of saved content. You should retain original sources or other backups of content that is important to you.

10. Limitation of Liability

Nothing in these Terms affects your mandatory rights under consumer law or excludes or limits liability that cannot legally be excluded or limited.

We do not exclude or limit liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation; or
any other liability that cannot legally be excluded or limited.

To the extent legally permitted, Poach Apps Ltd is not responsible for:

losses that were not reasonably foreseeable;
losses caused by your breach of these Terms;
inaccuracies or failures in third-party content or services; or
loss of locally stored content where Poach was not expressly providing a backup service.

11. Third-Party Websites

You are solely responsible for ensuring that your use of content from third-party websites complies with their respective terms of service, privacy policies, and copyright regulations. Poach Apps Ltd is not responsible for the legality or availability of third-party content. See also Section 5 regarding copyright and intellectual property.

12. Ending Use and Access to Online Features

You may stop using Poach at any time.

Poach may restrict or suspend access to online features if you materially breach these Terms, use the Services unlawfully or abusively, create a security risk, or if restriction or suspension is required by law. We will give reasonable notice where practicable.

Poach may change or discontinue features, but doing so does not remove your subscription rights or mandatory consumer rights.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. This does not deprive consumers of any mandatory protections under the laws of their home jurisdiction or, where applicable, their right to bring proceedings there.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on the Website or within the App and will apply from their stated effective date. Where appropriate, we will provide reasonable additional notice of material changes.
